1. Object and scope

These Terms govern the access and use of DomainCuore (domaincuore.com) and the domain-name intermediation services offered by Precedo Inversiones S.L. (hereinafter, “DomainCuore”). They apply to all users: visitors, registered buyers, guest buyers and partners. The conditions herein are complementary to the Legal Notice and the Privacy Policy.

2. Definitions

  • Buyer Natural or legal person who acquires a domain through the marketplace.
  • Partner Authorised seller who contributes one or more domains to the marketplace and has entered into the corresponding agreement with DomainCuore.
  • Marketplace The DomainCuore platform where domains are listed, auctions run and payments are processed.
  • AuthCode Transfer authorisation code (auth-info / EPP code) required to move the domain to another registrar.
  • Dutch auction Auction format where the price starts high and decreases over time until reaching the minimum price or a buyer decides to purchase at the current price.
  • Escrow Custody of the buyer’s payment until the partner completes the delivery of the domain.

3. How the marketplace operates and DomainCuore’s role

DomainCuore acts as the fiscal seller vis-à-vis the buyer: it issues the corresponding invoice, collects the payment and, once delivery of the domain is confirmed, settles the partner through approved invoices after deducting the agreed commission. The buyer contracts with DomainCuore, not with the partner. The partner remains responsible for ownership, legibility and transferability of the domain until the effective delivery.

4. Dutch auction and price

Each domain is listed with a starting price and a minimum price, and a decay rate. The buyer may acquire the domain at any time at the price in force at that instant. The first purchase automatically closes the auction and locks the domain for that buyer. Purchases are not nominative until the buyer completes identification and payment.

5. Payment, delivery and authCode

Once payment is confirmed, DomainCuore holds the funds in escrow and triggers the delivery workflow. The partner must provide the authCode within the agreed deadline. Upon receipt, DomainCuore delivers it to the buyer together with the instructions to transfer the domain to the destination registrar. If the partner does not deliver the authCode on time, DomainCuore proceeds with a full refund in accordance with its policy.

6. Right of withdrawal

Pursuant to Article 103(m) of the Spanish General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007), the right of withdrawal does not apply to the purchase of a domain name, given that it is a digital good delivered immediately by making the authCode available to the buyer. By completing the purchase, the buyer expressly accepts this exclusion and consents to the start of the service before the withdrawal period expires.

7. Refunds

DomainCuore refunds the full amount paid when: (a) the capture of the domain during the drop is not possible; (b) the partner fails to provide the authCode within the agreed deadline; (c) the domain cannot be transferred for technical or administrative reasons attributable to the partner; or (d) the charge is duplicate or unauthorised. In all other cases, DomainCuore assesses each request individually and may offer alternative solutions such as a replacement by another equivalent domain or credit on the platform.

8. Taxes

Applicable taxes are calculated based on the destination territory of the transaction and the nature of the operation. Precedo Inversiones S.L. is based in the Canary Islands; transactions from the Canary Islands are subject to the Canary Islands General Indirect Tax (IGIC) and, where applicable, the Arbitrary Tax on Production and Imports in the Canary Islands (AIEM). For transactions to other territories, the local VAT or equivalent rules apply, including any exemptions and reverse-charge situations when applicable.

9. Governing law and jurisdiction

These Terms are governed by applicable Spanish and European law. For the resolution of any disputes, the parties submit to the Courts and Tribunals of Las Palmas de Gran Canaria (Spain), except where procedural or consumer-protection regulations mandatorily establish a different jurisdiction.
